The lease contract sets out the rules governing the rental of the property. The tenant pays rent to the lessor in exchange for the use of the leased property.  <\/p><p>Since 2018, the lease contract has become regional. Each of the three Belgian regions has established its own regional housing code. Each administrative region of Belgium has established its own lease model.  <\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-37320ef elementor-widget elementor-widget-heading\" data-id=\"37320ef\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">What's in a rental lease?<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-92b0ccf elementor-widget elementor-widget-text-editor\" data-id=\"92b0ccf\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>To comply with Belgian federal law on the subject, the lease must contain certain mandatory details. At a minimum, the lease must specify the following points: <\/p><ul><li>the lessor&#8217;s personal details, complete identity and address;<\/li><li>the tenant&#8217;s personal details, i.e. full identity and address;<\/li><li>the address and detailed description of the property to be rented;<\/li><li>the start date of the rental period and the duration of the rental lease ;<\/li><li>the precise amount of the monthly rent and an estimate of the related charges;<\/li><li>the date of signature of the rental lease and the signature of all parties to the contract.<\/li><\/ul><p>All the additional information provided in the rental lease helps to clarify the contract between the lessor and the lessee.<\/p><p>The <span style=\"text-decoration: underline;\"><a href=\"https:\/\/garantie.be\/en\/rental-surety\/\">rental guarantee<\/a><\/span> is not a compulsory condition of the rental lease, but a paragraph on tenant guarantees can be found in almost all rental leases in Belgium.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t\t\t<section class=\"elementor-section elementor-top-section elementor-element elementor-element-cbcd652 elementor-section-boxed elementor-section-height-default elementor-section-height-default\" data-id=\"cbcd652\" data-element_type=\"section\" data-e-type=\"section\">\n\t\t\t\t\t\t<div class=\"elementor-container elementor-column-gap-default\">\n\t\t\t\t\t<div class=\"elementor-column elementor-col-100 elementor-top-column elementor-element elementor-element-b1ad937\" data-id=\"b1ad937\" data-element_type=\"column\" data-e-type=\"column\">\n\t\t\t<div class=\"elementor-widget-wrap elementor-element-populated\">\n\t\t\t\t\t\t<div class=\"elementor-element elementor-element-1aedfe7 elementor-widget elementor-widget-heading\" data-id=\"1aedfe7\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">  How long is a rental lease?<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-e5b4de6 elementor-widget elementor-widget-text-editor\" data-id=\"e5b4de6\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>In Belgium, there is no such thing as an open-ended lease. Leases must be for a fixed term. In principle, the law defines a 9-year term for the lease of a principal residence in Belgium.  <\/p><p>The law also allows, under certain conditions, a short-term lease (a lease of less than 3 years) or a long-term lease (a lease of more than 9 years) for the lease of a principal residence.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-ee83dff elementor-widget elementor-widget-heading\" data-id=\"ee83dff\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">Different types of leases<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-e5981bd elementor-widget elementor-widget-text-editor\" data-id=\"e5981bd\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<h3>Principal residence lease<\/h3><p>A principal residence lease is a rental agreement covering the tenant&#8217;s principal residence. To qualify as a principal residence lease, the lease contract must meet three mandatory conditions: <\/p><ul><li>The rental contract must be a residential lease. This means that the tenant declares that he\/she lives in the rented property; <\/li><li>The tenant must also declare that this is his or her principal residence. In other words, the tenant lives mainly in this dwelling; <\/li><li>The lessor agrees to the property&#8217;s use as a principal residence.<\/li><\/ul><p> <\/p><p>The fact that it is a lease for a principal residence brings with it a number of protections for the tenant. Belgian law requires the lessor to comply with additional rules concerning the safety, health and habitability of the rented property.
