This security enables the lessor to guarantee himself in the event of the lessee failing to meet one of his obligations under the lease contract. <\/p>\n<p>Rental guarantees come in a variety of forms, as described below. The process is detailed as follows: <\/p><h3>Constitution of the warranty<\/h3><p>The tenant must first set up a rental guarantee. There are several ways of doing this, the main ones being : <\/p><ul><li>Make a <span style=\"text-decoration: underline;\"><a href=\"https:\/\/garantie.be\/en\/security-deposits\/\">security deposit<\/a><\/span> in a blocked bank account<\/li><li>Obtain a bank guarantee <span style=\"text-decoration: underline;\"><a href=\"https:\/\/garantie.be\/en\/rental-bank-guarantee\/\">bank guarantee<\/a><\/span><\/li><li>Obtaining a <span style=\"text-decoration: underline;\"><a href=\"https:\/\/garantie.be\/en\/belgium-rental-surety\/\">rental deposit<\/a><\/span> from a guarantor<\/li><li>Make a <a href=\"https:\/\/garantie.be\/en\/security-deposits\/\"><span style=\"text-decoration: underline;\">rental deposit<\/span><\/a><\/li><\/ul><p> <\/p><p>The amount of the guarantee required by the landlord is limited by law in Belgium. The housing code of each of the 3 administrative regions defines the legal limit on the amount payable for the rental guarantee. <\/p><h3>Warranty certificate<\/h3><p>Once the rental guarantee has been set up, the institution that establishes the existence of the rental guarantee produces a rental guarantee certificate, which is sent to the lessor of the rental property. This guarantee certificate certifies to the landlord that the tenant has set up a rental guarantee before signing the rental lease.  <\/p><h3>Using the rental guarantee<\/h3><p>Blocked or bonded funds are used to cover financial commitments under the lease that the tenant has not honored. To obtain the funds or the bond, the lessor must first take legal action against the lessee and enforce the judgment obtained. <\/p><h3>Release from rental deposit<\/h3><p>The freezing of funds or surety commitments terminate at the end of the <span style=\"text-decoration: underline;\"><a href=\"https:\/\/garantie.be\/en\/real-estate-lease-contract\/\">rental lease commitments<\/a><\/span>.
