El inquilino, a su vez, se convierte en arrendador frente al subarrendatario. <\/p><p>Esta pr\u00e1ctica est\u00e1 permitida en B\u00e9lgica, pero s\u00f3lo con <strong>el acuerdo por escrito del arrendador<\/strong> y mediante la redacci\u00f3n de un contrato independiente, conocido como subarriendo. Este contrato establece los derechos y obligaciones de cada parte y debe ser coherente con el <a href=\"https:\/\/garantie.be\/es\/contrato-alquiler\/\">arrendamiento<\/a> principal: el subarrendatario no puede tener m\u00e1s derechos que el arrendatario original. <\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-5d14eedd elementor-widget elementor-widget-heading\" data-id=\"5d14eedd\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">\u00bfEs legal subarrendar tu vivienda en B\u00e9lgica?<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-35277d91 elementor-widget elementor-widget-text-editor\" data-id=\"35277d91\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>S\u00ed, <strong>el subarriendo es legal<\/strong>, pero est\u00e1 estrictamente regulado.<\/p><p>En B\u00e9lgica, el C\u00f3digo Civil autoriza el subarriendo <em>siempre que el arrendador haya dado su consentimiento por escrito<\/em>.<br>Sin este consentimiento, el subarriendo es ilegal y puede dar lugar a la rescisi\u00f3n del contrato de arrendamiento principal. La autorizaci\u00f3n puede ser necesaria para : <\/p><ul><li><strong>toda la propiedad<\/strong>: por ejemplo, en caso de expatriaci\u00f3n temporal;<\/li><li><strong>s\u00f3lo una parte: <\/strong> piso compartido, habitaci\u00f3n, kot, etc.<\/li><\/ul><p>El contrato de subarrendamiento debe redactarse por escrito y ser firmado por ambas partes. entre :<\/p><ul><li><strong>El arrendador principal<\/strong>: sigue vinculado al arrendatario inicial.<\/li><li><strong>El arrendatario principal<\/strong>: se convierte en subarrendador frente al subarrendatario.<\/li><li><strong>El subarrendatario<\/strong>: ocupa la vivienda seg\u00fan los t\u00e9rminos del contrato de subarrendamiento.<\/li><\/ul><p> <\/p><p>El inquilino principal <strong>sigue siendo responsable ante el propietario<\/strong>: si el subarrendatario causa da\u00f1os o no paga el alquiler, el propietario emprender\u00e1 acciones contra el inquilino original.<\/p><p>Por eso es fundamental :<\/p><ul><li>Redacta un subarriendo claro y completo.<\/li><li>Establece una <a href=\"https:\/\/garantie.be\/es\/fianza-de-alquiler\/\">fianza de alquiler<\/a> independiente.<\/li><li>y haz <a href=\"https:\/\/garantie.be\/es\/inventario-estado-inmueble\/\">acta de entrega<\/a>.<\/li><\/ul>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div la duraci\u00f3n del contrato principal.
