Le locataire devient donc, \u00e0 son tour, un bailleur vis-\u00e0-vis du sous-locataire.<\/p><p>Cette pratique est autoris\u00e9e en Belgique, mais \u00e0 condition <strong>d\u2019obtenir l\u2019accord \u00e9crit du propri\u00e9taire<\/strong> et de r\u00e9diger un contrat distinct, appel\u00e9 bail de sous-location. Ce contrat fixe les droits et obligations de chaque partie et doit \u00eatre coh\u00e9rent avec le <a href=\"https:\/\/garantie.be\/fr\/bail-de-location\/\">bail de location<\/a> principal : le sous-locataire ne peut pas avoir plus de droits que le locataire initial.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-5d14eedd elementor-widget elementor-widget-heading\" data-id=\"5d14eedd\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">Est-ce l\u00e9gal de sous-louer son logement en Belgique ?<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-35277d91 elementor-widget elementor-widget-text-editor\" data-id=\"35277d91\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>Oui, <strong>la sous-location est l\u00e9gale<\/strong>, mais strictement encadr\u00e9e.<\/p><p>En Belgique, le Code civil autorise la sous-location <em>\u00e0 condition que le propri\u00e9taire ait donn\u00e9 son accord \u00e9crit<\/em>.<br \/>Sans cet accord, la sous-location est ill\u00e9gale et peut entra\u00eener la r\u00e9siliation du bail principal. L\u2019autorisation peut concerner :<\/p><ul><li>la <strong>totalit\u00e9 du logement<\/strong> : par exemple en cas d\u2019expatriation temporaire ;<\/li><li>une <strong>partie seulement :\u00a0<\/strong> colocation, chambre, kot, etc.<\/li><\/ul><p>Le contrat de bail de sous-location doit \u00eatre r\u00e9dig\u00e9 par \u00e9crit et sign\u00e9 par les deux parties.
