Elle est encadr\u00e9e par la loi mais elle n\u2019est pas obligatoire. Elle est impos\u00e9e dans la plupart des baux d\u2019habitation.<\/p><p>La loi sur les loyers pr\u00e9voit que la garantie du locataire puisse \u00eatre fournie au travers d&rsquo;un compte bloqu\u00e9 dans une banque belge. La banque ING propose en Belgique ce service d\u2019ouverture de compte en banque individualis\u00e9 pour la garantie locative. Le compte individualis\u00e9 ouvert aupr\u00e8s de la banque ING pour y loger le montant de la garantie est au nom du locataire. Il sera bloqu\u00e9 jusqu\u2019\u00e0 la fin de bail ou jusqu\u2019\u00e0 un accord pr\u00e9alable des deux parties locataire\/ bailleur pour lib\u00e9rer la garantie locative de chez Cette offre de services est tr\u00e8s diff\u00e9rente d&rsquo;un autre service de la banque ING qui est la Garantie bancaire locative ING.<\/p><p>ING propose effectivement plusieurs services de garanties bancaires, dont un contrat de <span style=\"text-decoration: underline;\"><a href=\"https:\/\/garantie.be\/fr\/garantie-bancaire-locative\/\">garantie bancaire locative<\/a><\/span> dans le cadre d&rsquo;un bail immobilier. Le formulaire compl\u00e9t\u00e9 est sign\u00e9 par les parties au contrat, puis transmis par la poste en original \u00e0 l&rsquo;agence bancaire ING ayant bloqu\u00e9 les fonds.<\/li><li>Sur pr\u00e9sentation d&rsquo;une d\u00e9cision judiciaire : Ce jugement doit \u00eatre ex\u00e9cutoire et statuer express\u00e9ment sur la dette du locataire au profit du bailleur.
