What is the rental guarantee in Wallonia?
The rules governing rental guarantees have changed in recent years in Belgium. Since 2018, the three Belgian regions have defined their own rules for residential leases. Regional rules now take precedence over federal laws.
When it comes to rental guarantees, each of the 3 regions has its own rules. The legal maximum amount required for the rental guarantee depends on the region. This guarantee is not required by law, but most principal residence contracts provide for it.

The Walloon Housing Code
The law in force at federal level in Belgium regarding residential leases is the Rent Act.
This federal law was last updated with its 14th edition in March 2013.
In recent years, each region has introduced its own regional regulations governing residential leases.
The sixth reform of July 1, 2014 concerning the regionalization of residential leases also concerns the rental guarantee.
The application of regional rules since 2018 in Wallonia is based on its new Housing Code, which takes precedence over the federal law on residential lease rules.
How much is the rental guarantee in Wallonia?
The maximum amount varies according to the type of lease.
It will depend on the lease between the lessor and the lessee. Depending on the type of guarantee you choose, you will be required to pay between 2 and 3 months’ rent (maximum), excluding charges.
- In the case of a CPAS bank guarantee, or a conventional bank guarantee, regardless of the region, 3 months’ rent will be required as a rental guarantee;
- In the case of a rental guarantee set up on an individual account, the amount requested by the landlord is a maximum of 2 months’ rent;
- In the case of other types of warranty, the law does not lay down any principles, leaving the parties to the contract free to agree.
In Wallonia, it is customary to withhold a maximum of 2 months’ rent under a guarantee obtained from a guarantor.
What assistance is available in Wallonia to set up a rental guarantee?
Wallonia offers two main types of assistance for building up a rental guarantee. These are, of course, reserved for people on low incomes. Here are the types of assistance offered by Wallonia:
The zero-rate loan
Since May 2021, Wallonia has been granting zero-interest loans to make up the rental guarantee for principal residence leases. This zero-interest loan can represent up to 100% of the amount of the rental guarantee. The zero-rate loan is only granted subject to certain income conditions on the part of the applicant.
CPAS assistance
In Wallonia, the CPAS offers various forms of assistance in setting up a rental guarantee. This CPAS assistance takes the form of an advance on the rental guarantee, to be repaid as and when required, or a letter of guarantee for the landlord, or even a bank guarantee.
