Basic Principle

Korfine will only release the material upon signed agreement by both parties

Unlike with a bank account, you cannot get your security deposit back on your own. Korfine requires either a mutual agreement between the tenant and the landlord or a court order. Here are the three possible scenarios.

Case 1 · Out-of-court settlement

The landlord and tenant sign the release form together. Korfine transfers the principal amount to the tenant (minus any agreed-upon deduction). Processing time: 2 to 4 weeks.

Case 2 · Dispute Involving a Withholding

The landlord disputes the claim and asks Korfine to withhold all or part of the rent. Korfine withholds payment until an agreement is reached or a judgment is issued. The matter must then be brought before the justice of the peace.

Case 3 · Court Ruling

The justice of the peace renders a decision. Korfine carries out the decision without further delay. The principal (or the remaining portion) is transferred within 10 business days.

Detailed Procedure

How to Get Your Korfine Security Deposit Back: 5 Steps

Follow these steps in order. Most delays are caused by a missing form or a landlord who is slow to sign.

1

Exit inventory

The move-out process cannot begin without an inventory report signed by both parties (or prepared by an expert). This serves as the legal basis on which the landlord may or may not raise complaints.

2

Written Agreement / Deductions

If all goes well, the landlord and tenant will agree on the amount to be refunded. If the landlord requests repairs, both parties must agree on the amount. This agreement must be put in writing—preferably by email or certified mail.

3

Release Form

The official Korfine termination form is available directly here: → Download the Korfine termination form.
This form must be completed and signed by both the tenant AND the landlord. You can also request it at info@korfine.be.

4

Send the signed form

Please send the signed form to Korfine by email (info@korfine.be) or through the customer portal. Include a copy of your IBAN if your bank account information has changed since you signed up.

5

Transfer of Paid-in Capital

Korfine will transfer the principal (plus any interest, depending on the terms of the contract) to the tenant’s IBAN within 2 to 4 weeks after receiving the completed and signed form.

Good to know: Korfine is a Branch 26 life insurance policy. The capital tied up for the duration of the lease may generate a minimal return (often 0% in practice for recent policies). Check your policy to see if you are entitled to interest.

Common Problems

Korfine won’t release your bond: what should you do?

Most roadblocks have a clear solution. Here are the most common situations.

Scenario A

My landlord refuses to sign the release form

Send a formal notice by certified mail to your landlord, asking him to sign it or to provide a written explanation for his refusal. If you receive no response, or if the reason given is unfounded, file a complaint with the justice of the peace in the jurisdiction where the rental property is located. The process is quick and inexpensive (revenue stamp). Korfine will enforce the judgment.

Scenario B

My landlord is requesting a deduction that I believe is unjustified

Do not sign a withholding agreement that you dispute. Korfine will freeze the funds pending an out-of-court settlement or a court ruling. Compile a photo dossier (inventory report, dated photos) and file a claim with the justice of the peace if negotiations fail.

Scenario C

I sent the signed form over a month ago, and Korfine still hasn’t transferred the money

Follow up by email to info@korfine.be, copying your original message. If you do not receive a response within 10 business days, file a complaint withthe Insurance Ombudsman (free service): ombudsman-verzekeringen.be.

Scenario D

I can’t find my Korfine contract number anymore

Search your emails for a document titled “warranty statement” or “deposit certificate.” If you can’t find it, contact Korfine with your last name, first name, date of birth, and the address of the rental property—they can locate your file in their system.

Objective Assessment

Korfine’s Release: What’s Going Well and What’s Not

✓ What Works Well

  • Faithful Enforcement — Korfine scrupulously complies with court decisions. There is no additional grace period once a judgment has been rendered.
  • Secured capital — the capital cannot be misappropriated by the lessor during the term of the lease.
  • A clear recourse —in the event of a deadlock, the justice of the peace is a well-established and inexpensive option.

✗ Limits You Should Know

  • Agreement by both parties is required —without the landlord’s signature, you cannot recover anything outside of court.
  • 2 to 4 weeks — even in the case of a mutual agreement, the transfer is not immediate.
  • Capital tied up for the entire term of the lease —unlike with garantie.be, you do not have access to your money during the term of the contract.

Frequently Asked Questions

FAQ — Korfine Bail Release

How long does it take to get Korfine’s bail released?

If you reach an amicable agreement with your landlord, please allow 2 to 4 weeks after Korfine receives the completed and signed form. If the dispute is resolved by a justice of the peace, Korfine will carry out the decision within 10 business days of receiving notice of the judgment.

Can my landlord keep my entire Korfine security deposit?

No. The landlord may only withhold amounts corresponding to actual, provable, and documented damages (inventory report, invoices). An unjustified withholding may be challenged before a justice of the peace, who will order Korfine to refund the unjustified balance to you.

What happens if my landlord doesn’t respond to Korfine?

If your landlord does not respond within a reasonable time after the lease ends, send him a formal notice by certified mail. If you do not receive a response, you can file a claim with the justice of the peace. The law requires the landlord to return the security deposit within 3 months of the lease’s end, unless there is an ongoing dispute.

Can I get my Korfine security deposit back without my landlord’s consent?

Only through legal proceedings. Without the landlord’s written consent, Korfine cannot release the funds—this is a legal requirement inherent in the Belgian rental guarantee system, regardless of the institution involved. The only alternative is a ruling by a justice of the peace.

Does my Korfine security deposit earn interest during the lease term?

Korfine is a Branch 26 life insurance policy. In theory, the principal can generate a guaranteed return, but this return is often zero or very low on recent policies (0.00% on many policies since 2020). Check your individual policy to find out the rate applied to your account.

Can Korfine refuse to release my bail even if there’s a court order?

No. Korfine is legally required to comply with any final court decision. If Korfine refuses to comply or takes an unreasonably long time to do so after a judgment has been issued, file a complaint with the Insurance Ombudsman (ombudsman-verzekeringen.be)—a free and effective remedy.
