Subletting your home in Belgium is perfectly legal, provided you comply with certain rules. The main tenant may rent all or part of his home to a subtenant, with the written authorization of the landlord.
Below is a free sublease template that complies with Belgian legislation in 2026.

Article 1 – Purpose
The sub-lessor sublets to the sub-lessee the dwelling located at :

This dwelling constitutes the subtenant’s principal residence.
Article 2 – Duration
The present lease is concluded for a duration of [duration in months] months, commencing on
[date de début] and ending on [date de fin].
It may not exceed the duration of the main lease signed between the owner and the sub-lessor.
Article 3 – Rent and charges
The monthly rent is set at [amount in euros] €, payable on [day of month]
of each month to the IBAN account: [IBAN number].
Monthly charges are estimated at [amount of charges] €, corresponding to
[description: water, gas, electricity, etc.].
Article 4 – Rental guarantee
The sub-tenant pays a rental guarantee of [amount in euros] €,
deposited via garantie.be or in a blocked account in its name.
This guarantee will be returned at the end of the lease, after verification of the inventory report.
Article 5 – Inventory report
An inventory report will be drawn up before the keys are handed over.
An inventory report will be drawn up on departure of the sub-tenant.
Article 6 – Obligations
The sub-tenant undertakes to comply with the clauses of the main lease, the building regulations,
and to maintain the accommodation in a good state of repair.
The sub-lessor remains liable to the principal owner.
Article 7 – Registration
The present lease will be registered free of charge on
MyMinfin.be
within two months of signature.

Tips for using this sublease rental lease template
- Always obtain the landlord’s written consent: Before subletting, make sure you have the permission of the main landlord. Without this agreement, subletting is illegal and may result in termination of the main lease.
- Adapt the template to your actual situation : This template is a legal basis, but you must insert the exact information:
- full address of the property,
- duration,
- rent and service charges,
- terms and conditions of the rental guarantee,
- contact details of both parties.
- The contract must reflect the reality of the accommodation and the agreed conditions.

- The term of the sublease may not exceed that of the main lease.
